Orders Before Our Lease Is Terminated

My husband has been on limited duty since September. He had surgery to remove his appendix in March and was cleared for full duty at the end of April. His primary care doctor has been holding up orders because he has to sign off on the limited duty. All he has to do is fill out a form which he has had for over a month. Meanwhile, our landlord, knowing that we are awaiting orders and we will be moving soon, gave us 60 days notice to vacate and we have to be out of our apartment by August 1. My husband is in Great Lakes and our children and I are in Baltimore, MD. I contacted the Chaplain in Great Lakes yesterday and he spoke to my husband and his Chief today to try to expedite the orders. He said that he and the Chief are going to speak to the doc to see if they can get him to fill out the paperwork to have my husband officially off of limited duty so that he can get his orders. I am so scared that we won't get orders and/or housing in time for us to get out of this apartment before we have to leave and we are going to be homeless. We have been waiting for this doctor to fill out this paperwork for over a month since he cleared him for full duty. I hope that the Chaplain and the Chief can get him to fill it out soon and they can get the orders expedited before our lease is terminated.

Check with FFSC/Legal...I dont think they can do that.

I know BY LAW in VA,I am allowed to break a lease if we get orders.

Just that we don;t have a lease..
We just show the landlord his orders when he gets them and we move out whenever we can.

I hope that is his Chief is able to things moving so that you guys can get orders!

We are on a month to month lease and per the lease either party can terminate the lease by giving 60 days notice. We can terminate the lease sooner with orders. We moved in to this apartment before my husband joined the Navy. My landlord is just being a jerk. He's a slumlord. Anytime there is a problem with the building, it takes several phone calls and several weeks for him to do anything about it. I have had to threaten him several times with contacting the department of housing and/or legal before he took care of maintenance problems in the building. Last month, he refused my rent check and took me to court and tried to evict us. This month, I mailed the rent check on time <it goes to a p.o. box and I dropped it off directly to the post office where the p.o. box is>, and the check still hasn't been cashed. It's now June 11, he should have had it for at least a week now so it should have cleared my bank by now. I can't wait to get out of here.

I spoke to my husband last night and he said that his Chief and a a couple of other Chiefs that he works with are going to push for him to stay in Great Lakes so they can make sure that he gets housing immediately. They are also going to make sure that the doctor fills out the paperwork even if they have to get the Master Chief or even the Admiral involved. Apparently the doctor is being separated from the Navy soon and that is all he seems to be worried about. Making sure that his ducks are lined up in a row. So hopefully, they light a fire under him and he gets this taken care of immediately so that we can get orders and get out of here.

If not, I will have to go to legal and see what I can do about all this. I just hope that it won't come down to that. I want to be out of here long before I have to fight my landlord in court. I really don't want to have to deal with him anymore than I have already had to deal with him.

I spoke to the Chaplain today. Seems like the doc gave him the run around on the subject too. He said that he is going to go talk to the doc again today and speak to my hubby as soon as he can. I text my hubby and he is gonna talk to his Chief today and see if he can do anything. He just sent me a message and the Chief left the doc a message. We have just 6 weeks to get out of this apartment. My nerves are shot and this doctor can't seem to be bothered to do his job. From what my hubby says, the form should take no longer than about 5 minutes to fill out and the doc has already cleared him for full duty so I don't know what his problem is. He's had it for over a month. UGH!!!

GOOD NEWS!!! The doc FINALLY filled out the paperwork and got it over to the Lim Du Coordinator. They contacted my hubby's Chief yesterday so he will be seeing them on Monday and then to the Career Counselor probably on Tuesday. WOOHOO!!! Looks like things are getting to where they need to be. I'll keep everyone updated as I know what's happening. Hopefully we will have orders by the end of the week and housing too. His Chief is putting in word to have him stationed in Great Lakes so that he can push through housing as quickly as possible. They have plenty of housing available there. I pray this goes as smoothly as my hubby thinks it will. :)

The housing that I saw in Great Lakes was amazing. I don't know if there's more than the one's I saw but I really wish I could have housing like that.
